Abstract

The purpose of this study was to determine the reason for non-compliance with the payment of civil reparations by those sentenced in the first and second Penal Court of Huancavelica during the year 2015. To achieve this objective, the descriptive and explanatory method was applied. The hypothesis testing was done using the proportions test of the normal distribution and for the general hypothesis, the Chi-square test, in both cases with a significance level of 5%, confidence level of 95%, and a margin of error of 5%. The confrontation of specific hypotheses was carried out, as well as the general hypothesis, where null hypotheses were rejected, and consequently, alternative hypotheses were accepted, which are: (H1)(Ha): The execution of the payment of civil reparations is at most 30%; (H2) (Ha): the judge did not predominantly adopt an appropriate subjective criterion regarding the type of crime in which it was set, in determining the reasonable payment period, and the imposition of payment execution; in the application of the reservation of the condemnatory ruling; (Ha): There is at least an 80% non-compliance with the payment of civil reparations; therefore, it becomes inadequate by the First Penal Court of Huancavelica during the year 2015. The appropriate and inadequate applicability of civil reparations in the First Penal Court has been obtained that more than before the first secretary in 66% and before the second secretary of the court, it was found without any execution in 71%. It is concluded, therefore, that there is an inadequate application of civil reparations in the First Penal Court of Huancavelica during the year 2015.
