Recently in January 2022 there was an oil spill at the La Pampilla Refinery on the Peruvian coast, a media case compared to the spills that happen throughout the Peruvian Amazon all the time and are ignored. The objective of the study was to evaluate the inconsistency and legal gaps regarding the laws on oil and hydrocarbon spills due to the fact that they are not rigorous enough, which is why in the Peruvian Amazon oil spills are very common where oil spills are not drastically sanctioned. the responsible. The sanctions that are given in case of contamination are measured by the certainty of the damage committed to the health of the environment, seeing the civil, criminal and administrative responsibility that is protected by Peruvian legal laws of the environment and international agreements, who grant these sanctions are bodies autonomous entities such as the Ministry of the Environment (MINAM) and the Agency for Environmental Evaluation and Control (OEFA), which are also in charge of the conservation and sustainable use of natural resources.
